Acceptable Use Policy
1. Purpose & Scope
This Acceptable Use Policy ("AUP") defines the boundaries of permitted use on the Zcope platform. It applies to all content created, uploaded, hosted, or distributed through the Platform, including newsletters, scorecards, digital products, email sequences, and any future features.
This policy is designed to protect our users, preserve our platform's integrity, and comply with legal obligations across multiple jurisdictions (US, EU, UK, Australia, Canada, Switzerland, and Latin America).
2. Absolutely Prohibited Content (Tier 1)
The following content is absolutely prohibited and will result in immediate account termination and, where legally required, reporting to law enforcement:
| Category | Description | Legal Basis |
|---|---|---|
| Child Sexual Abuse Material (CSAM) | Any content depicting or promoting child sexual exploitation, including AI-generated CSAM | 18 U.S.C. Chapter 110; mandatory NCMEC reporting |
| Terrorism & Violent Extremism | Content promoting, glorifying, or facilitating terrorism or violent extremism, including recruitment material | EU Terrorist Content Regulation; UK OSA; AU OSA |
| Non-Consensual Intimate Imagery | Intimate images shared without the depicted person's consent, including deepfakes | State revenge porn laws; UK OSA; AU OSA |
There is zero tolerance for Tier 1 content. We are legally required to report CSAM to NCMEC (National Center for Missing & Exploited Children) and may report other illegal content to appropriate authorities.
3. Prohibited Content (Tier 2)
The following content is prohibited and subject to graduated enforcement (warning, restriction, suspension, or termination):
| Category | Description |
|---|---|
| Hate Speech & Incitement | Content promoting hatred or inciting violence against individuals or groups based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristics |
| Fraud & Deceptive Schemes | Ponzi/pyramid schemes, fake testimonials, guaranteed income claims, and other content designed to defraud users |
| Copyright Infringement (Repeat) | Systematic or repeated use of copyrighted material without authorization. Our DMCA three-strike policy applies. |
| Impersonation & Identity Fraud | Pretending to be another person or organization to deceive others |
| Doxxing & Privacy Violations | Publishing private information (addresses, phone numbers, financial info) about individuals without consent |
| Unqualified Regulated Advice | Providing specific medical, financial, or legal advice without proper qualifications or required disclaimers |
4. Restricted Content (Tier 3)
The following content requires remediation (adding disclaimers, age gates, or other corrective measures). Failure to remediate after notice may escalate to Tier 2 enforcement:
| Category | Description | Required Action |
|---|---|---|
| Misleading Health/Financial Claims | Exaggerated or unsubstantiated health or financial claims | Add required disclaimers and evidence |
| Age-Inappropriate Content | Adult content accessible to minors without age-gating | Implement age verification |
| Spam & Excessive Messaging | Sending unsolicited or excessive commercial communications, purchased lists | Remove non-consented contacts; comply with CAN-SPAM |
| IP Misuse (Single Incident) | Single-incident use of copyrighted or trademarked material | Remove or license the material |
5. AI-Generated Content Guidelines
When using Zcope's AI features (voice profiling, copy generation, content suggestions), you must:
- Review before publishing: All AI-generated content must be reviewed and approved by you before publication
- Take responsibility: You are responsible for all published content, regardless of whether it was AI-assisted
- Not generate prohibited content: Do not use AI features to create content that violates any tier of this policy
- Verify accuracy: AI outputs may be inaccurate — verify claims before publishing, especially health, financial, or legal information
Content may be processed by automated safety screening systems. This does not constitute pre-approval of your content.
Image Content: Uploaded images are subject to the same content policies as text content. This includes images used in newsletters, product pages, scorecard landing pages, and any other public-facing surfaces. AI-generated images are also subject to screening. Images that violate this policy will be automatically blocked at upload time and may trigger enforcement actions.
6. Email Sending Rules
All email sent through the Platform must comply with CAN-SPAM, GDPR, and other applicable email regulations:
- Only send to recipients who have opted in to receive your communications
- Never use purchased, rented, or scraped email lists
- Never send deceptive, misleading, or fraudulent emails
- The Platform automatically includes unsubscribe links and compliance headers
- Unsubscribe requests are processed automatically — do not interfere with this process
Violations of email sending rules may result in immediate suspension of email sending capabilities.
7. Enforcement Process
Our enforcement follows a graduated approach based on violation severity:
- Notice (Level 0): Informational notification about a potential concern
- Warning (Level 1): Formal warning with a violation record. First occurrence of Tier 2 violations.
- Restriction (Level 2): Content hidden and publishing disabled until remediation. Escalated Tier 2 violations.
- Suspension (Level 3): All public pages offline and account access restricted. Repeated Tier 2 violations.
- Termination (Level 4): Account permanently disabled. Any Tier 1 violation or repeated serious violations.
Tier 1 violations skip the graduated process and result in immediate termination.
8. Reporting Violations
If you encounter content on Zcope that you believe violates this policy, please report it:
- Email: abuse@zcope.app
- Include: URL of the content, description of the violation, and your contact information
We review all reports and take action within 48 hours for standard violations and 24 hours for Tier 1 content.
9. Appeals
If you believe an enforcement action was taken in error, you may appeal by contacting appeals@zcope.app with:
- Your account information
- The enforcement action you are appealing
- An explanation of why you believe the action was incorrect
We will review appeals within 5 business days and provide a written response with our decision and reasoning.
